Jury Services
The right to a trial by jury is the privilege of every person in the United States, whether citizen or not. This cherished right is guaranteed by both the United States and California Constitutions. Jury trials cannot be held unless people like you are willing to perform their civic duty. Jurors are essential to the administration of justice. A jury is a selected group of citizens which hears the testimonies in a legal dispute and determines what they believe is the truth. Q&A
The following questions are answered below:
How Will I Know if I Have to Serve?
Your date to appear and group number are shown on the reverse side of your Summons. To determine if you are required to appear, YOU MUST CALL THE RECORDED MESSAGE 749-7602 AFTER 5:00 p.m. THE NIGHT BEFORE YOUR DATE OF SERVICE. Please listen to the entire message, as it provides important information regarding your service. (return)
When Will I Have to Serve Again?
If you are required to appear for jury duty, whether you are selected to serve as a trial juror or not, you will be excused from service for 12 months. However, you will become eligible next calendar year to be summoned again. If you are NOT required to come to the Courthouse on your appearance date, your name will remain in the pool of prospective jurors and you may receive another summons this calendar year. (return)
Where Do I Report for Jury Duty?
If the recorded message instructs your group number to report, you should report at 8:45 a.m. to the Second Floor of the Yuba County Courthouse, 215 Fifth Street, Marysville. BRING YOUR SUMMONS WITH YOU. Please report promptly as late arrivals are subject to rescheduling. (return)
How Long Will I Be There?
Jury trials begin weekly on Tuesday (Wednesday if Monday is a holiday). The jury selection process is usually concluded in one day, and the average trial lasts two to four days. Some trials last longer; the judge will inform you of the anticipated length of the trial. Court usually ends by 5:00 p.m., however, jurors may occasionally be asked to remain past 5:00 p.m., especially if deliberation is in progress and near completion. Jurors are not required to stay overnight. (return)
What About My Job?
You should notify your employer immediately of impending jury duty. No employer can discharge or in any manner discriminate against an employee for taking time off to serve on jury duty, provided the employee gives reasonable notice to the employer. Any adverse action by an employer may result in money damages or prosecution for a misdemeanor (Labor Code § 230). (return)
Will I Be Paid?
By law, California jurors are not paid mileage or per diem for the first day's service. However, jurors are paid $15.00 per day, plus one-way mileage at the rate of $.34 per mile from your residence to the courthouse, for the second and each succeeding day of service. A check will be mailed to you two to three weeks after your complete jury service. Should you desire to waive mileage, please notify the Jury Clerks. (return)
How Can I Get Out of This?
Jury duty is a mandatory obligation of citizenship. California law reads in part, “No eligible person shall be exempt from service as a trial juror by reason of occupation, race, color, religion, sex, national origin, or economic status, or for any other reason” (CCP § 204). Failure to appear as summoned could result in a fine, jail sentence, or both (CCP § 209). If you have moved from Yuba County, or have been convicted of a felony, please call 749-7601. (return)
Can I Postpone This to Another Date?
If you feel you cannot serve on your appearance date and you feel you have sufficient grounds to be excused, please call Jury Services at 749-7601 between the hours of 8:30 a.m. and 4:30 p.m. weekdays. Requests for rescheduling should be made at least three working days prior to the date of service, if possible. (return)
